  • Country refers to: Karnataka, India
  • Service refers to the Website, apps, portal and translation, localization and consulting services provided by the Company
  • Client Material refers to the content for translation uploaded or emailed or shared through any medium by Customers on the Portal including glossaries, memories, style guides and instruction sheets
  • Translated Material refers to the Client Material that we have performed Services on, including but not limited to translated, localised, proofread or edited material
  • Terms and Conditions (also referred as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
  • Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
  • Website refers to Milestone Localization, accessible from https://milestoneloc.com/
  • Portal refers to our client portal, accessible from https://client.milestoneloc.com/
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
  • Customers means visitors registered users of the Service who seek to use the service

Using Our Portal

You represent that you are 18 years of age, or of the age of majority in your place of residence or jurisdiction. By using our client port, including creating an account, asking for a quote, submitting files or any other activity performed on our portal, you agree to

  • Be responsible for the activity that happens in connection with your Milestone account
  • Keep your password and log in details confidential
  • Notify the company immediately in case of any unauthorised use of your password
  • Not create multiple accounts for any reason
  • Allow us to process your data according to our Privacy Policy
  • Not abuse or conduct illegal activity using our portal
  • Not defame or harass our company, or its employees, contractors, Customers, or Translators

Client Materials Disclosure

We disclose Client Materials uploaded by customers to potential translators or agencies in order to provide the Service to Customers. Potential translators or contractors or agencies will review this information to check the subject, assess if they are able to work on the document and prepare quotes.

You are solely responsible for editing, masking or removing any confidential or personally identifiable information in the Client Materials if you do not wish to disclose that information to the company or third parties in our supply-chain.

 

Links to Other Websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately.

Intellectual Property

All documents, logos, catch phrases, text, are trademarks of the Company. The content is protected by intellectual property laws and may not be copied, distributed, modified, published, or transmitted in any manner without prior written permission.

Third party trademarks displayed on the website are owned by their respective owners. They may not be reproduced in whole, or in part, without the written permission of the owner.

If you submit feedback or suggestions about our company or services, we may use your feedback (in part or whole) without notice or obligation. All submitted feedback is considered to be non-confidential and property of Milestone and we may use it to promote our Service

All Translated Material becomes intellectual property of the Customer once it is approved and paid for by the Customer in full in compliance with the Terms and Conditions.

If You give Us written permission to use the Client Material or Translated Material in case studies or in our portfolio as “public examples”, Milestone had a worldwide, royalty-free and perpetual license to display your Client Material and Translated Material to promote and improve our Service. This license continues even after you stop using the Service.

In order to provide You and our other Customers the best possible translation and language services, We (and those we work with including third part translators or agencies) may use your Client Materials and Translated Materials to develop and improve the Services (this includes but is not limited to training machines for AI driven machine translation, creating translation memories, improving machine translations, creating language databases) and create new products or services ourselves or in partnership with third parties. If we do this, we will never make your Client Materials or Translated Material publicly available.

Milestone shall be thee sole and exclusive owner of all inventions, methodology, innovations, know-how, and databases developed by Milestone in the course of translating the Client Materials, including any and all patent rights, copyrights, know-how, and trade secrets therein.

Limitation of Liability

In no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. The laws of Karnataka, India, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Terms shall not effect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service.
You agree that the original English text shall prevail in the case of a dispute.
